Hire
1. Parties, agreement and commencement
1.1 This Agreement is between Sleeptime Australia Pty Ltd trading as Sleeptime Medical (“we”, “us”) and the Customer in the Hire Schedule (“you”). “Equipment” includes listed accessories. The Hire Schedule, this Agreement and any mutually agreed written variation form the hire contract.
1.2 The hire begins on the agreed start date, subject to payment, identity checks where reasonably required, signing and equipment availability. Equipment is subject to availability and is not reserved for you until we confirm your booking. The start date you choose online is your preferred date only. We will contact you to confirm delivery or collection, and we do not guarantee a particular date or time. If we cannot supply the agreed Equipment, we will offer a suitable alternative only with your consent or provide the refund or remedy required by law.
1.3 The initial hire period, any minimum term, recurring charges and renewal arrangement must be stated in the Hire Schedule or clearly disclosed at checkout. Hire is priced per week, with a minimum of 2 weeks. Hire fees are paid in advance in 4-week billing cycles, and hire continues until you give us notice to end the hire under clause 4.
2. Delivery, collection and sanitisation
2.1 The one-time service fee is $165 for ground-level delivery (including buildings with a lift) or $225 where the address is upstairs with stairs only and no lift (up to 2 storeys). For addresses above 2 storeys, please contact us before booking. The fee includes delivery to the agreed address, collection at the end of hire and cleaning/sanitisation after return. Click & Collect from our Prestons showroom is free. The fee is payable at commencement and is separate from hire fees. Any non-standard location or service charge must be disclosed and agreed before it is incurred.
2.2 Delivery and collection dates and times are estimates only. We will confirm a date with you after your order and we do not guarantee a delivery or collection date. You must provide safe, reasonable access at mutually arranged times. We will arrange collection after receiving termination notice and agreeing a collection date. Delays caused solely by our inability to collect at an agreed time will not attract extra hire charges.
2.3 At handover, inspect the Equipment where practicable and promptly tell us about missing items, damage or faults. We may document condition with a checklist or photographs.
Hire terms & payments
3. Hire fees, card authorisation and additional amounts
3.1 You agree to pay the disclosed hire fees in advance, for each 4-week billing cycle. No security bond is required. We use an authorised payment provider for secure payment.
3.2 By separately authorising recurring payments, you permit the payment provider to charge the agreed hire fees under the disclosed schedule. A card-on-file arrangement alone does not authorise every later charge. Any separate damage, loss or late-return charge requires a valid applicable payment authorisation and compliance with provider rules and law.
3.3 We will notify you in writing of proposed additional charges, the basis and supporting details, and give you a reasonable opportunity to dispute them before charging an authorised method. We will issue a receipt and will not charge amounts that are not properly payable.
4. Ending hire, extensions and returns
4.1 You must give at least seven (7) calendar days’ notice to end hire by telephone on (02) 9018 9255 or email to info@sleeptimemedical.com.au. Notice starts when received. We will confirm the notice and coordinate a collection/return date.
4.2 The hire ends on the later of the applicable minimum-term end date and the effective date following the seven-day notice, unless another date is agreed or the law requires otherwise. The Equipment must be returned or made available for agreed collection, including accessories. You are not responsible for delay solely attributable to us.
4.3 If you request an extension, we may agree to continue hire at the disclosed rate. Any changed rate or term requires your agreement. If you retain Equipment beyond the agreed return date without an extension, reasonable disclosed hire charges may accrue for the period of customer-caused delay, subject to law.
4.4 Any early cancellation fee must be specifically disclosed before checkout and must be lawful and proportionate. Refunds and remedies for non-supply, defective Equipment or other failures remain subject to Australian Consumer Law.
4.5 Refund of unused weeks. Because hire fees are paid in advance, if hire ends part-way through a paid 4-week cycle, we will refund the hire fees for the unused weeks after the hire end date, once the Equipment has been returned or collected. The refund is made to your original payment method. The 2-week minimum term still applies.
5. Customer obligations and appropriate use
5.1 Use Equipment only for its intended purpose, within stated weight and safety limits, and according to supplied instructions. Ensure anyone using or operating it understands relevant directions. Do not alter, dismantle, sell, sub-hire, pledge or dispose of Equipment.
5.2 Keep Equipment reasonably clean and secure, avoid misuse and prevent avoidable damage. Do not relocate Equipment without advising us and obtaining agreement where location affects safety, servicing or collection.
5.3 Where clinical assessment or suitability advice is needed, seek an appropriate health professional’s advice. This does not reduce our legal obligations about safety, quality or fitness for a disclosed purpose.
6. Faults and maintenance
6.1 Stop using Equipment that may be unsafe and notify us promptly. Do not attempt repairs or engage a repairer without approval except for immediate action reasonably necessary to prevent harm.
6.2 We remain responsible for defects, ordinary wear and tear, and repairs for which we are legally responsible. We will provide remedies required under the Australian Consumer Law.
Condition, damage & ownership
7. Damage, loss and evidence
7.1 If Equipment is damaged, lost or stolen, notify us as soon as reasonably practicable. For damage, email photographs and a description to info@sleeptimemedical.com.au. If unsafe, cease use and follow our safety instructions.
7.2 We may compare handover and return photographs, inspect the item and obtain reasonable repair or replacement estimates. You are liable only to the extent loss or damage results from your misuse, negligence or breach, and not for fair wear and tear, inherent faults or loss caused by us.
7.3 Before requesting payment, we will send written notice explaining the damage, evidence, amount and calculation, taking into account age, condition, depreciation and actual reasonable loss. You will have a reasonable opportunity to provide information or dispute the assessment.
7.4 We may process a substantiated amount against a securely retained payment method only where separately and validly authorised under the payment arrangements, after the notice and dispute opportunity in clause 7.3, and as permitted by law. We will supply a receipt. A dispute does not prevent either party from using legal remedies.
8. Title, possession and access
8.1 Equipment remains owned by Sleeptime Australia Pty Ltd or its lawful owner. Hire grants temporary possession and use only. You must not grant any third party an interest in the Equipment.
8.2 Risk of loss or damage attributable to your conduct is assessed under clause 7; you do not assume responsibility for defects or circumstances for which we are legally responsible merely because the Equipment is in your possession.
8.3 You agree to cooperate with reasonable inspection, maintenance and collection arrangements on advance notice. We will not enter a home or other private premises without consent or other lawful authority.
9. Termination for breach
9.1 Either party may end hire in accordance with clause 4 and applicable law. We may terminate for a material breach, including substantial unpaid fees, unauthorised disposal or dangerous misuse, after giving reasonable notice and an opportunity to remedy where appropriate.
9.2 After lawful termination, you must make Equipment available for return or collection. Accrued lawful amounts remain payable, but we may not impose a penalty or recover more than reasonably justified loss. Rights under consumer law remain unaffected.
10. Customer and equipment user
10.1 The person signing as Customer is responsible for contractual payment and return obligations. Where another person uses the Equipment, the Customer must have authority to supply necessary contact information and ensure safe-use instructions are communicated. This clause does not make an equipment user a party unless that person separately agrees.
11. Electronic acceptance
By ticking the agreement box at checkout, I confirm I am at least 18, have authority to enter this Agreement, have received the Hire Schedule, understand the disclosed fees and notice requirements, and agree to the terms. I acknowledge that any separate recurring-payment or additional-charge authorisation must be obtained in accordance with the payment provider’s requirements.
Please note: by accepting these Terms and Conditions on our website, you acknowledge that you have read, understood and agreed to be bound by this Equipment Hire Agreement.
